Service and purchase

Comercialia is a workspace to organise prospects and prepare texts, proposals and plans with artificial intelligence. Clio can check up to three public pages of a website you provide and show its sources. The service does not include browsing private accounts or unlimited company searches.

Prospecting agents. Only if you expressly turn it on, an agent writes first sales emails to the contacts you assign to it and, if you choose, up to two follow-ups to those who have not replied. You can choose between preparing drafts that you approve one by one or sending them automatically, within the schedule and daily limit you set (from 1 to 50 emails a day per agent). To write, it may read the contact's public website. The emails are sent from the email account you connect, not from Comercialia, and each one includes a way to unsubscribe. Before turning it on you declare that you have a legal basis to write to those contacts (for example, their prior consent or a previous contractual relationship) in accordance with the applicable law, including the Spanish LSSI and the GDPR. You are responsible for those emails, their content and handling unsubscribe requests, and you can pause the agent at any time. An email already being transmitted cannot be withdrawn. If you change an agent's instructions or account, it is paused until you authorise it again.

No number of sales, replies or customers is guaranteed, nor delivery to the inbox: your server accepting an email does not prove it was received or read.

The service is intended for businesses and professionals. You must be of legal age, provide accurate data and be authorised to use the data and connect the accounts you add. An account represents a company workspace. Keep your credentials private. You can ask for help or for your account to be closed by writing to support.

Prices and credits

Prices in euros before taxes. Taxes are calculated at checkout according to the buyer's country and status: for example, for Spanish domestic sales subject to the standard 21 % VAT, the monthly totals are €35.09, €95.59 and €240.79, and the top-ups €22.99, €83.49 and €143.99. Business customers in the European Union who provide a valid VAT number may be invoiced under the reverse-charge mechanism. Your bank may convert the amount to your currency. Stripe shows the total and applicable taxes before payment. There is no set-up fee. Your email provider and other external services you contract are not included.

Credits are units of use of the service, not electronic money or a balance exchangeable for cash. They accumulate with no scheduled expiry while the account remains available. Each task reserves balance and deducts the confirmed usage, with a minimum of one credit; it releases the unused part. A Clio task reserves up to 50 credits and other actions up to 150. If the provider does not confirm the usage, the reservation may be held until it is reviewed by support. There are no automatic top-ups and no negative balance. The free mode with OpenRouter uses 1 credit per confirmed answer, with a maximum of 5 model requests a day per account and subject to a shared allowance. It may be less available and does not switch automatically to paid models. When you buy credits or a plan, new tasks use OpenAI.

To protect the service, frequency and budget limits apply: one pending AI task per account, up to ten requests per minute and up to 1,000 credits used per day per account. There is also a global daily limit that may temporarily pause the AI. You can still access your CRM data. Plans do not promise unlimited availability or a fixed number of tasks per credit.

Referral programme

Any customer can recommend Comercialia with their personal link or code. When the invited company completes a purchase or a monthly payment, service credits are added: to the invited company, an extra 10 % of the credits of its first purchase, and to the inviter, 25 % of the credits of that first purchase and 10 % of the following purchases and monthly payments for 90 days from when the invitation is recorded. The inviter's reward is credited 14 days after the purchase. It does not apply to purchases of prospecting records. There is a maximum of 5,000 credits per purchase and 20,000 credits per month per customer.

Rewards are service credits, not electronic money or a balance exchangeable for cash, and follow the same usage rules as other credits. The invitation can only be recorded during the first 14 days of the invited account and before its first purchase. Self-invitations, duplicate accounts and the use of third-party data without permission are not allowed. If the payment is refunded or disputed, or abusive use is detected, Comercialia may cancel the reward, withdraw unused credits and block the accounts involved until they are reviewed. Comercialia may pause, change or close the programme with reasonable notice; credits already added are kept. This invitation is not a commercial communication on behalf of Comercialia: the inviter is responsible for complying with the law that applies when sharing their link, including rules on commercial communications and data protection.

Business search and prospecting balance

The prospecting package includes 1,000 records for €15 plus taxes (€18.15 for a Spanish domestic sale subject to 21 % VAT). This balance is separate from AI credits, is not converted into them and is not topped up automatically. It is used in batches of up to 100 businesses by sector and city, with a maximum of 1,000 businesses requested per company every 24 hours and subject to the service allowance. The requested size is reserved and one record is used per new business delivered; undelivered units are returned to the balance. Public sources are kept. Businesses may have no website or email; no number of emails, their verification or that each city completes the batch is guaranteed. The search includes trying to read the business's public website, without AI analysis, email verification, sending or additional paid enrichment. Results must be reviewed before importing them into the CRM. Their publication does not imply authorisation to send commercial communications.

Research of URLs provided by the user uses the AI balance: 10 credits per page extracted, up to 10 per batch; failures are not charged.

Payment, renewal and cancellation

Before paying you can review the package, the price and these terms. Payment is made through Stripe. Credits are added when the server verifies the charge; returning from the payment screen is not by itself a confirmation. We keep the order and its confirmation in your account, and you can see the plan's invoices in the billing portal.

Plans renew monthly until you cancel the renewal from Plans and credits. Cancellation applies at the end of the current period and keeps the credits already added. A failed renewal does not add new balance. To change plan, cancel and wait for the current period to end. A refund or dispute may suspend AI usage until the payment concerned is reviewed.

Report duplicate charges, errors or incidents to support with the order reference. We will review the charges and make the adjustments or refunds that apply. No term limits mandatory rights that apply to you. If you buy as a consumer, you may exercise the legal right of withdrawal within 14 calendar days of the purchase, by sending an unambiguous statement to support with your identification and order. Using the service is not presumed to be a waiver of withdrawal. You also keep the legal conformity rights and complaint channels that apply.

Responsible use

Check the statements generated by AI. Do not upload special category data, passwords in conversations, third-party secrets or unlawful content. An email address published on the internet does not imply consent to advertising. You must have the corresponding legal basis and respect unsubscribe requests. Do not use the service for impersonation, spam or unauthorised access. Restrictions for abuse will be applied proportionately; you can ask support to review them.

Privacy

The controller of your account and billing data is the owner identified above. We process your email, company name, Google identifier if you choose that sign-in, billing data, settings, operations and communications with support. Sign-in passwords are stored as hashes; integration credentials are encrypted. Stripe processes card data: Comercialia does not store the full number.

We use this data to provide the service and manage the contractual relationship; to meet tax and accounting obligations; and to protect accounts, prevent fraud and resolve incidents in our legitimate interest. We do not use your conversations or contacts to send you third-party advertising. You can use email and password without signing in with Google.

If you give an IMAP server for an email account or turn on the follow-ups of an agent that sends from it, Comercialia reads over IMAP, in read-only mode, the date, sender and conversation references of the recent messages in your inbox to know which contacts have replied and not write to them again. It does not open or store the content of those emails and stops checking each send after 30 days.

Necessary providers are involved: Hostinger for the website and transactional email, Vercel to host the application, Neon for the database, OpenAI to process the texts sent to the AI; in the free mode, after activation by the user, OpenRouter and the selected free providers under no-data-collection and zero-retention restrictions; Stripe for payments and Google for the optional sign-in. When you request a business search, Apify receives the sector and city given to obtain public records; we do not send it your inbox or CRM content. Scrapling runs on our infrastructure to check the related public websites. Only the context needed for the task you request is sent to the AI provider. Some operations may involve processing outside the European Economic Area; you can ask support for information about the providers, their locations and the applicable contractual safeguards.

We keep working data while the service is provided or until you ask for it to be deleted, with the exceptions needed to meet legal obligations, claims or fraud prevention. Tax documents are kept for the applicable legal periods. Sessions expire and recovery links last 30 minutes. Backups keep up to 30 days of history and are used only for recovery.

You can request access, rectification, erasure, objection, restriction and portability at soporte@comercialia.xyz. We will verify your identity proportionately and reply within the legal deadlines. You can complain to the Spanish Data Protection Agency (AEPD) or to the supervisory authority of your country.

Data your company adds

Your company decides what it uses the prospect, message and document data it adds for, and acts as controller of that processing. Comercialia processes it to carry out your instructions within the service, during the contractual relationship. Categories may include professional contacts, opportunities and conversations. We do not use that data for our own commercial purposes.

We undertake to keep it confidential, limit access, apply appropriate security measures, assist with rights requests and incidents, report security breaches without undue delay where applicable and provide reasonable information to demonstrate these obligations. The technical providers listed above are used for the necessary operations. Material changes of providers will be communicated before they apply so that you can object. At the end, you can ask for your data to be returned or deleted, except where retention is required by law. For processing that requires additional agreements, safeguards or terms, contact support before adding that data.

Cookies and storage

The application uses technical session cookies and cookies for the Google sign-in process. They are needed to identify your account and protect sign-in. No first-party advertising cookies are set in the application. Links to Stripe, Google and social networks open external services with their own policies. You can delete cookies from your browser; you will lose your session.

Availability and changes

There may be maintenance, third-party limits or incidents. If they prevent the service you purchased, contact support to resolve them and apply the measures that correspond. Changes to prices or terms affecting future renewals will be communicated in advance and will allow you to cancel before they apply. Spanish law applies, without depriving you of the protections or competent courts that apply to you by mandatory law.
